2. Subject matter

These Terms of Service govern the contractual relationship between IDFABRIK (hereinafter "VerifyBot" or "Provider") and the customer (hereinafter "Customer") for access to and use of the VerifyBot monitoring service. VerifyBot provides automated Playwright-based website monitoring, including custom script development, continuous execution, alerting, and a private dashboard (Cockpit).

3. Plans and pricing

ESSENTIAL — €49/month
1 custom monitoring script (up to 30 test points), hourly checks, email alerts, Cockpit access, test archives, 1 script update per month included.

BUSINESS — €149/month
3 custom monitoring scripts, checks every 15 minutes, desktop + mobile testing, Slack/Webhook/Email alerts, 2 script updates per month included.

CUSTOM — on request
Unlimited scripts, checks every minute, multi-device, 24/7 priority support, SLA available.

All prices are exclusive of VAT where applicable. Billing is monthly and recurring.

4. Conclusion of contract

The contract is concluded when the Customer completes the payment process via Stripe Checkout. Upon successful payment, the Customer receives a welcome email with access credentials to the Cockpit. The contract term begins on the date of payment.

5. Payment

Payment is processed securely by Stripe (Stripe Payments Europe, Ltd.). The Customer authorises a recurring monthly charge to the provided payment method. Invoices are available in the Stripe customer portal.

6. Right of withdrawal

Pursuant to § 356 para. 5 BGB, the right of withdrawal for digital services expires upon commencement of performance, provided the Customer has given express consent and acknowledged the loss of the right of withdrawal. By completing the checkout, the Customer expressly requests immediate commencement of service and acknowledges that the right of withdrawal is thereby waived.

7. Contract duration and cancellation

Subscriptions are monthly and renew automatically. The Customer may cancel at any time via the Stripe customer portal or by contacting [email protected]. Cancellation takes effect at the end of the current billing period. No refunds are issued for the remaining period.

8. Provider obligations

VerifyBot undertakes to: develop a custom monitoring script within 5 business days of contract conclusion; execute monitoring according to the contracted plan interval; send alerts upon detection of failures; make the Cockpit dashboard available with a target uptime of 99%. Scheduled maintenance is excluded from uptime calculation.

9. Customer obligations

The Customer undertakes to: provide accurate information during onboarding; ensure that the monitored website permits automated access (robots.txt, rate limiting); keep access credentials confidential; not use the service for any unlawful purpose.

10. Limitation of liability

VerifyBot's liability is limited to intent and gross negligence. In cases of slight negligence, liability is excluded except for breach of material contractual obligations (cardinal obligations). In such cases, liability is limited to foreseeable, typical damages. VerifyBot is not liable for damages resulting from false negatives (failures not detected) or for third-party service outages beyond its control.

11. Data processing

VerifyBot processes personal data in accordance with its Privacy Policy and applicable GDPR provisions. All infrastructure is hosted in Germany. A Data Processing Agreement (DPA) is available upon request and included by default for Business and Custom plans.

12. Governing law and jurisdiction

These Terms are governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes is Berlin, Germany, provided the Customer is a merchant (Kaufmann) or a legal entity under public law.

13. Dispute resolution

The European Commission provides an online dispute resolution platform: ec.europa.eu/consumers/odr. VerifyBot is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

14. Miscellaneous

Should any provision of these Terms be or become invalid, the remaining provisions shall remain unaffected. German statutory law shall apply to fill any gaps. These Terms may be updated at any time; the Customer will be notified by email at least 14 days in advance of material changes.
